Unconstitutional Checkpoint! Are the THC Chickens Coming Home to Roost?

In this article I photographically documented 2 miles of checkpoint signs leading up to the actual checkpoint. These photographs were taken on Friday, July 30, 2010 in Montana.

Are you aware that an international agricultural health code has been implemented down to the state and local level? There is actually a trilogy in the Terrestrial Health Code (THC) series, each over 1300 pages with the mandate to control all life. Many of us have become desensitized to the mostly unconstitutional travel checkpoint. In researching this article I made an attempt to discover the history of travel checkpoints but was unable to find their origins. Societies that desired the strong arm of control instituted capricious and demanding checkpoints. Today the government has expanded their checkpoint system from border crossing inspections to state and local roads for a variety of “reasons” from the war on drugs (DUI), insurance mandates, vehicle defects, to seatbelts. Most Americans are unaware that around 2006 most states have instituted unconstitutional agricultural checkpoints. What are the implications of such actions taken by these United States of the Republic?

States’ Animal Identification Statutes

On February 5, 2010, the Secretary of Agriculture, Tom Vilsack, announced the abandonment of the National Animal Identification System (“NAIS”), which was a voluntary federal program meant to identify and trace the movement of animals throughout their life cycle. NAIS was implemented in order to facilitate the quick identification of animals that had been exposed to a potential disease threat. Instead of NAIS, Secretary Vilsack explained that a new approach would be taken, with states and tribal governments bearing responsibility for their respective identification programs. Since the programs are now state-based, they will necessarily be governed by state-specific laws as well. This compilation of States’ Animal Identification Statutes provides the statutory text of each state’s laws dealing with animal identification programs, along with the date of its possible expiration. The primary aim of this compilation is to provide the researcher with easy and free access to a state’s statutory language by simply clicking on the state’s image in the map below.

Food Safety: The Worst of Both Bills (HR 2749 & S 510)

If S 510 (the FDA Food Safety Modernization Act) passes the Senate, there would be a conference committee between members of the House and Senate to draft a food safety bill that would combine provisions of S 510 and HR 2749 (the Food Safety Enhancement Act of 2009) into a final version of the bill. The full House and Senate each would vote on this version of the bill to determine whether the food safety bill becomes law.

S.510 and HR 2749 represent landmark legislation that will significantly increase the federal government’s power to regulate intrastate commerce while hurting this country’s ability to produce safe food and to become self-sufficient in food production.

Both bills take a one-size-fits-all approach towards food regulation, threatening to leave small farmers and local producers unable to afford the cost of complying with the legislation’s requirements. They would also significantly increase the power of the federal government to regulate intrastate commerce and give the Food and Drug Administration (FDA) substantially greater power overall while making the agency less accountable for its actions.

In reality, neither bill would improve food safety; in fact, the new requirements would cause an increase in imported food, a major source of the food safety problems in this country. Either bill would diminish the freedom and liberty Americans currently have to obtain the food of their choice from the source of their choice. What follows is a review of the more damaging provisions of the two bills under the following subheadings:

Animal Cruelty Videos Protected as Free Speech

Today the United States Supreme Court ruled in United States v. Stevens that a federal law banning videos showing animal abuse violates the First Amendment right to free speech.

The ruling was 8-1, with Justice Alito the lone dissenter. Chief Justice John Roberts wrote the opinion for the majority, which can be accessed by clicking here. Roberts found the law was overly broad, and according to Robert Barnes reporting for the Washington Post, Roberts “rejected the government’s argument that whether certain categories of speech deserve constitutional protection depends on balancing the value of the speech against its societal costs.”

The Social Distancing Law Project Template: A Method for Jurisdictions to Assess Understanding of Relevant Legal Authorities

Karen Leeb, JD, MLS, Denise Chrysler, JD, and Richard Goodman, MD, JD, MPH, recently authored the article “The Social Distancing Law Project Template: A Method for Jurisdictions to Assess Understanding of Relevant Legal Authorities” in the March issue of the journal Disaster Medicine and Public Health Preparedness, © 2010 American Medical Association. The article summarizes the Social Distancing Law Project (SDLP) and its implementation by 17 selected jurisdictions in 2007, and reports on the experience of one jurisdiction, Michigan, as a case example. Ten additional states are implementing the project in 2010. The article also describes the SDLP template developed for other state and local health officials’ use in assessing their legal preparedness for communicable disease outbreaks. The template and additional resources can be downloaded from http://www2a.cdc.gov/phlp/SDLP. The CDC Public Health Law Program gratefully acknowledges the American Medical Association’s permission to post this article.

March 15, 2010 When we notice somebody pointing at something, we automatically look in the direction of the gesture. In humans, the ability to understand this type of gesturing (known as declarative communication) may seem to be an automatic response, but it is actually a sign of sophisticated communication behavior. Numerous studies have tried to determine if great apes (for example, chimpanzees and bonobos) are able to understand declarative communication, but results have been mixed.

A Primer on Public Health Law

Public health officials have broad authority to ensure a safe and orderly community.  State laws tend to be broad and do not set forth, in detail, specific criteria on how or when public health officials can or should issue orders.  There is very limited guidance on the how long an order should be in place, the process for issuing orders and for the legal enforcement of orders.  Nor is there guidance on legal recourse or the implementation of orders or the legal process should health officials face non compliant citizens.

Wisconsin state laws give local health officers great latitude in keeping the public healthy.  With this latitude comes a loss of freedom and privacy.  Justification for this loss of freedom and privacy stems from the notion that people’s actions can have a devastating effect on the overall health and well-being of a community and that quick action is vital if public health officials hope to contain the spread of communicable diseases. It is also understood that personal freedom is not an absolute right.

The most commonly referenced containment measures applied on an individual level are isolation and quarantine.  The Public Health Seattle and King County website offers a comprehensive tool for public health agencies seeking to implement and enforce isolation and quarantine orders.
