States’ Animal Identification Statutes

On February 5, 2010, the Secretary of Agriculture, Tom Vilsack, announced the abandonment of the National Animal Identification System (“NAIS”), which was a voluntary federal program meant to identify and trace the movement of animals throughout their life cycle. NAIS was implemented in order to facilitate the quick identification of animals that had been exposed to a potential disease threat. Instead of NAIS, Secretary Vilsack explained that a new approach would be taken, with states and tribal governments bearing responsibility for their respective identification programs. Since the programs are now state-based, they will necessarily be governed by state-specific laws as well. This compilation of States’ Animal Identification Statutes provides the statutory text of each state’s laws dealing with animal identification programs, along with the date of its possible expiration. The primary aim of this compilation is to provide the researcher with easy and free access to a state’s statutory language by simply clicking on the state’s image in the map below.

Porkers Calling for the Return of Animal ID Pork

It has been determined by the President, Congress, and the Agricultural Committee that after years and millions of wasted taxpayer dollars the experiment to alter traditional animal identification methods failed dismally. But the porkers, true to their kind, want pork and more of it.  The porkers along with the Cattleman’s Association did fabulous acting jog pretending to be “the industry” when they went crying to state and Congressional leaders.   The USDA program known as the National Animal Identification System (NAIS)  was bold in their demands:

1.  Register all property (whether you own an animal or now, if you have potential to make $1000 from your property, not that you are making more, just the potential.  Why even apartment dwellers can do that.

2.  Electronically identify animals which we now know causes cancer thanks to the diligent work of Dr. Katherine Albrecht and an investigative reporter.  This was also a slam-dunk profit maker for new electronic identification methods.

3. 24/7 surveillance-Your papers please!  Health officials, under the Emergency Clause, not only in the US but around the world suspended national and state Constitutions as a few wealthy  individuals breached sovereign borders to make a few more dollars for their pockets.  If you take your chicken to the vet or travel on the roads or or maybe even take one of your animals for a walk it was proposed that you must file an extensive electronic report and carry the animals papers at all times.

Everyone you mention this scheme to thinks it is ludicrous!  Nevertheless farmers had to leave their farm, which by the way grow your food, to take to the marbled halls so that they could farm without squashing regulations.  The herald that funding had been terminated after this extravagant experiment brought a respite of sorts though several problems remained.

Most Americans are unaware of the the semantic shell game that goes on in the realm of politics.  NAIS was known as a contentious program yet the Department’s of Agriculture  persisted until the outcry became so loud that they could not dismiss it.  The USDA easily solved this dilemma with a pitch-fork response:  rename NAIS to Animal Disease Traceability; hold consensus meeting that really aren’t about the USDA listening to “We the People” (of course they do not have to listen because no where in our founding documents does it mention AGENCY, Department, Bureau, etc…; and lastly to bring back the pork ringer’s to squeal loud enough to drown out the voice of Americans saying, “No”.  One last thing you need to know as an American who needs to eat.  The Federal government knows that you need to eat and so their is a potential money-making operation laying in wait.  The Fed’s offered your state hard, cold cash, to receive grant money for NAIS.  The fine print of that contract, SF 424 A & B put your state on the hook to implement a whole lot more than NAIS, it included the Clean Water Act, Clean Air Act, and numerous Executive Orders.  Your state had to implement all of these to get the cash and then provide Quarterly Reports on their progress.


Why are we in this predicament?

High food prices and contaminated food are a consequence of the United States signing on as a Member to the United Nations and branches such as the OIE who partly manages our food.  The a series of treaties were signed that supposedly we had to go along with in the modern global socialist governance.  It is claimed that these treaties supersede our Constitution.  This is only the case if we voluntarily allow these treaties to be a highest law in our land.

Long ago it was determined that Americans had not more right to food than anyone else around the world so the UN along with its partner Congress decided to “level the playing field”.  What does this mean to you?   Everybody gets the same nutrition, calories, access to food, quantity.  And for good measure it is an excellent funding mechanism because everybody has to eat.

Can the government of the United States actually control and eradicate disease by a money-grubbing program?  The article below mentions all the jobs and wealth this animal identification program will create.  It fails to note that farmers will be driven out of business due to crushing OIE regulations and the cost to support global governance.  It  is laughable this article also says an animal ID program will “save the animals”.  The stark truth of the matter is that the porker’s nor global government cares one single animal.  The only thing that matters is the bottom dollar and making as much of it as they can.

Ponder these things when you go to your local grocery store.  You would do far better economically and health-wise to support your local farmers.  Choose farmers you really trust who  are not really big-agri-business in a sheep suit.  That put’s the porker’s  out of the game, unless you want to be poor and then die from poisoned and fake food.

10 Minute Sovereign:  Call your Congressmen and women, tell them: “No to funding on Animal Disease Traceability.  It is a waste of time and money and we no longer have that luxury.”  If you have a few additional minutes call the Senate Ag Committee and tell them the same thing.  Make sure your voice is heard.  We need to drown out the porker’s who have had their day for their animal identification venture.  Let’s return our Constitution to its rightful spot and return to our traditional ways that made this country the greatest nation in the world.  Apathy and failure to get involved on your part, yes you eat you best get involved, will otherwise sink America’s food supply and it will go down faster than the Titanic.  Is this what you want for your children and grandchildren.  It is food for thought.  Think about it instead of some other activity you are scheduled to do today.

Pit of Hell: US Farms get Federalized

War Against Food

Maybe you were unaware, or maybe you were not even born yet, but some 60+ years ago a war was declared against  ‘threats to [global] peace’, breaches of peace and acts of aggression which includes American agriculture and food.  Maybe you have not considered your dinner plate or your domesticated farm animals an ‘Act of Aggression’ but that is precisely how the UN views them.  We need to look at the particular UN Articles you need to understand America is a participating member and signatory of the UN.  The goal of the UN is to unite the world to a Utopian time of ‘peace’ under UN control and by their definitions.  A task force was set up in the early 1960′s to evaluate the best way to make transition to world peace.  Peace equates equals control.  Because there is human suffering and poverty the UN believes it is it’s task to bring about a ‘peaceful order’.

Here are the facts, nothing but the facts.

  • Only 2% of Americans grow food.
  • There are more prisoners in America than farmers.
  • Many farms are now foreign owned thanks to the overly intrusive regulations that each state and the federal government has passed and our lackadaisical protection of our borders.
  • America used to have hobby farmers who grew food and companion animals for their own family but those farms are rapidly becoming extinct with high prices and restrictions.
  • The global import/export market is growing at a quantum 6% a year.  It will not take long before complete dependence upon foreign products to take place.
  • The bioterrorism act of 20002 requires that all producers of food, retailers, and restaurants maintain records for traceability.

Many local farmers have been sounding the alarm that a famine is headed thanks to international treaties and contaminated foods.  Upon the revelation that the food supply was in grave danger small farmers got involved in legislative and the regulatory process.  They took time away from their families and took to the airwaves to educate folks on what was coming.  You say you didn’t see it on the front page of your local newspaper or on the 5 o’clock news?  For quite some time there has not only been dirty food, but also dirty politics.  Farmers successfully got many organizations and people on board.  Testimony and hearing rooms were filled to overfill capacity  but farming issues were considered ‘contentious’ and Agricultural Committee Chairmen, Editors, and Producers shied away unless they ran a “farmer fringe” column, beside the black helicopters.  The end result was that your local farmer, the folks who bring you nutritious, good, local foods were marginalized and rapidly became endangered.  This past year the pace for completion of the UN dream has escalated, taking a dramatic turn for the worse.  Contaminated food at an all time high despite an ever growing bureaucracy supposedly tasked with food safety and other facets of agricultural regulation.

The Constitution & Public Health

The 10th Amendment of the US Constitution reserves all powers for the states as the primary authority and protector of the public health.  The Supreme Court has understood that the federal government has a role in: environmental protection, occupational health & safety, food and drug purity.  The federal government contributes to public health in six ways:

  1. Setting health goals, policies and standards
  2. Financing
  3. Protecting public health
  4. Collecting and disseminating information about US public health and health-care delivery systems
  5. Building infrastructure of public health
  6. Managing services

The federal government has had a limited direct role in public health deferring to state and local government until recently.  Our Constitution equally divides public health responsibility.

  1. The Executive Branch establishes health regulations although not directly and ENFORCES public policy.
  2. The Legislative branch of the government at all levels enacts laws, develops policy, and allocates authorization and funding for policy.
  3. The Judicial branch  is to interpret the laws and adjudicate disputes (Gostin, 2000).

In the words of Lord Ashton, “Power corrupts, and absolute power corrupts aboslutely’ (Powell, 2001)  With the new health-care reform it is obvious that the checks and balances established by our Founding Fathers are out of whack.

State Department’s of Health are responsible to develop codes, determine what diseases are notifiable, sanitation standards for local commerce and health issues.  Each state clearly enacts health laws and regulations.

Federalism

Federalism is the term that defines the pattern of relationship between national, state, and local governments in America.  The Constitution of the United States reserves certain powers for the federal government and delegates the remainder to the states.  Although the Constitution is silent on local government, it has has created a situation in the United States in which:

  • The federal government has the money
  • The State government has the authority
  • The local government has the problem

This problem is traced back to Thomas Jefferson and the Federalist Papers.  What this means is that the money appropriated by the federal government will have to pass though several bureaucracies each with slightly different rules until the money gets to the local level.  It is a given that the person wirting the check has the control, whoever they may be.

Constitutional Cracking

The United States is a Republic, not a democracy, despite what you hear everywhere from the marbled halls to the news venues.  We have a solid Constitution and Bill of Rights which are bestowed upon us from God and cannot be taken or altered at whim.  We can all see that our form of government is under assault.  Can the Constitution and Bill of Rights be cracked?  The gauntlet was thrown down to professionals, to lawyers, to educators to find a way or means to shatter the United States of America.  Two breaches were found that could accomplish this task:  environmentalism and the historic loophole of emergency management, particularly as it applied to human and animal health.  Both methods involved exploiting a series of created and natural events seizing the opportunity to turn a minuscule hole in the dike into a dam breaking experience.  For years these events have incrementally reduced freedom, privacy and ownership in countries around the globe including the US.  A gigantic breach to liberty appeared after the events of September 11, 2001.  Today, in 2010, we are seeing the UN vision of total food control come into view.  An agricultural conference was held in the middle of March 2010, the NIAA.  The theme for this year was the rising tide of the  One World, One Health Initiative that seeks to unite medical, veterinary, and food sectors into one.  When it was first presented it was introduced as a think tank theory to a group of students.  Unknowing to most it was in fact the UN vision coming together.  One of the power points presented at this conference was an Private sector Business Continuity Plan for an Animal Health Emergency.  These plans are typically known as Public-Private Partnerships.  They create a commingled hybrid of government & business following the fascist model.

Devil in the Details

The United Charter was created in 1945 and signed in San Francisco.  A subsequent UN  Human Right Resolution containing 30 basic human rights were agreed upon by UN members.  These UN rights, contrary to the American Constitution and Bill of Rights with many other founding documents, would bestowed by UN.  This document was signed at the 183rd plenary meeting on 10 December 1948 to resolved to create a UN with muscle:

  • Justice
  • Tolerance
  • Unity
  • Peace

United Nations Charter, Chapter 7: Action with Respect to Threats to the Peace, Breaches of the Peace, and Acts of Aggression

Article 39

Anything that threatens  peace, breach of peace, or an act of aggression

The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken in accordance with Articles 41 and 42, to maintain or restore international peace and security.

Article 40

Call Upon the Parties to Comply

In order to prevent an aggravation of the situation, the Security Council may, before making the recommendations or deciding upon the measures provided for in Article 39, call upon the parties concerned to comply with such provisional measures as it deems necessary or desirable. Such provisional measures shall be without prejudice to the rights, claims, or position of the parties concerned. The Security Council shall duly take account of failure to comply with such provisional measures.

Article 41

Baby Teeth of Decisions

The Security Council may decide what measures not involving the use of armed force are to be employed to give effect to its decisions, and it may call upon the Members of the United Nations to apply such measures. These may include complete or partial interruption of economic relations and of rail, sea, air, postal, telegraphic, radio, and other means of communication, and the severance of diplomatic relations.

Article 42

Should the Security Council consider that measures provided for in Article 41 would be inadequate or have proved to be inadequate, it may take such action by air, sea, or land forces as may be necessary to maintain or restore international peace and security. Such action may include demonstrations, blockade, and other operations by air, sea, or land forces of Members of the United Nations.

Article 43

UN Armed Forces and Rights of Passage

1. All Members of the United Nations, in order to contribute to the maintenance of international peace and security, undertake to make available to the Security Council, on its call and in accordance with a special agreement or agreements, armed forces, assistance, and facilities, including rights of passage, necessary for the purpose of maintaining international peace and security.

2. Such agreement or agreements shall govern the numbers and types of forces, their degree of readiness and general location, and the nature of the facilities and assistance to be provided.

When you have a global government you must have a global police force that is omnipresent and virtually omnipotent to maintain freedom from war, living Disarmed in a Peaceful World.  This police force will cause kill people and cause much suffering.

World Health Organization, OIE , FAO & Member States

Global organizations, entities and member States began biosurveillance some time ago though the word has not been defined by the Oxford English Dictionary.  Leaving the word undefined technical experts must understand the term intuitively and calls for a broader synthesization of multidisciplinary professions.  As biosurveillance went global member state budgets escalated.  In 2005 the budget for the CDC was $8 billion and the median state health budget was $2.9 billion.  The total civilian biodefense funding in 2005 was estimated to be $7.6 billion with $452 million allocated for agricultural labs, monitoring and the like.

The World Health Organization (WHO) stated it’s objective in 1969:  “The attainment by all peoples of the highest possible level of health, defined as a state of complete physical, mental, and social well being and not merely the absence of disease or infirmity.  (WHO, 2005b)

International Health Regulations are two tools, IHR established in 1969 solely for the purpose of controlling yellow fever, cholera, and the plague,  but was difficult to enforce.  IHR that was amended in 2005 expanding its power to “prevent,  protect against, control, and provide provide an international health response” that takes into effect risk, economics, traffic, trade and tourism  IHR 2005 became effective in 2007.  These regulations harmonized with the OIE, FAO, and Codex.   They see their role (as opposed to member states):

  • Daily surveillance and international intelligence
  • Determining an international health emergency such as what we saw with the 2009 H1N1.
  • Provide technical public health assistance.
  • Guidance documents
  • Contain and control (Command & control)
  • Risk verification & assessment
  • Respond to state needs regarding interpretation and implementation of their regulations.

The biosureveillance system is like a military commander who cannot see the threats he faces.  The commander relies on ‘surveillance systems’ that include reports, reconnaissance, and sensing systems to make tactical decisions.  Both military commanders and biosurveillance organizations are high-stake decision makers. They both work under pressure, with incomplete and uncertain information.  Like a military commander a biosurveillance entity is primarily action oriented and conducts biosurveillance  as a means, not an end. Biosurveillance is a means to the end of protecting health quite in alignment with the UN.

Government began a new and different mode of operations after the attacks on September 11, 2001.  Government and the private sector merges with the surge of “Volunteerism”.  Reminiscent of Russia’s underground police, one would not know if the person one was standing next to was working for the government or an ordinary person who had taken the “incentive”.   After 911 the name of the game was “blend in”.

Who’s are the Fed’s?

You may have heard of the federal government’s Continuity of Government (GOG) plan.  A plan that ensures government continues in case a disaster befell America, everything else may collapse but the government will continue.  You may not know that after the year 2000 businesses began adopting or harmonizing a their Continuity Plan which dove-tails with local, state, US and international plans.

Just before the year 2000 as America was opening her borders to the world an epidemic of foreign animal diseases (FAD) emerged.  Are these diseases real?  Yes.  Some are natural and some are created or novel, made in one of many biological warfare laboratories strategically placed around the world.

Suddenly your local farmer was thrust into a battle to fight for clean and pure local foods.  Your local farmer is in the best position to determine if his or her animals are healthy and if there is any impending danger to you or your family.  The government has promised to keep you safe, yet cases of food contamination are off the charts. Government officials have no answer except more control and bigger government.

Your local family farmer knows when an animal is sick, what is normal and what is not. We are always interacting with our animals and we do not have any international conflict of interests.


Surely we trust veterinarians to tell us the truth regarding Foreign Animal Disease (FAD) threats?  in years past the public could trust their local veterinarians.  Sadly these days most vets are a part of a Veterinary Association.  The politics of those associations, often adopting the policies presented representing big money, compromising their ability to tell you the truth.  Many vets have signed paperwork to turn you and your private information into the government for a mere $10.  Ten dollars, can you believe it?

These forces need your voluntary help.  They want you to call into your vet all cases of disease.  Your vet will then call your animals problem to the Area-Vet-In-Charge (AVIC) who are under UN control.

You may ask, “What is proof of freedom”?  You can only obtain your “freedom” by:

  • Being inspected to UN standards
  • Being tested to UN standards
  • Being vaccinated to UN standards
  • Being electronically identified to UN standards

You then pay for a permit or license and are verified that you are in a state of complete physical, mental, and social well being and not merely the absence of disease or infirmity.  (WHO, 2005b).

Your Constitutional absolute right in property and to do what you choose to do with your property is suspended during a foreign animal disease event.  You might think of the suspension of commerce as martial law.  For all general purposes the UN has declared “war against disease” and intervention for threats to “peace & security” and “acts of aggression”  many years ago.   The UN has been ratcheting up those declarations thereby removing more and more freedom your lives.


Let’s read that again, slowly…….

In their own words the US and UN in tandem are going to use your census and ‘other’ information to:

  • RESPOND, DETECT, CONTAIN disease.  The UN clearly states complete physical, mental, and social well being so that includes all of us, everyone.
  • Eradicate and control disease.  Since we all have something or other, are they going to eradicate and control the disease, or the host?
  • Their response is going to regionalize and compartmentalize all of us within any sector that has disease or a inadequate physical, mental or social well being.
  • Their response will prioritize:  money over people.  At the beginning of the environmental movement it was fish over people.  That worked, no public outcry.
  • The recovery must be quick.

You can almost see the international grins with this next slight of hand.



You can see in the Table Top Exercise above that the Incident Command System is being set up on federalized farms.  The Incident Command System was first used in California after a disastrous fire.  Communication and organization was a real problem and the Incident Command System( ICS) evolved.  After successful implementation by Fire Services, Emergency Management adopted, refined and perfected, the ICS System.  The ICS became NIMS after September 11, 2001 .

Each federal farm will be in a zone.  Zones are not our traditional boundaries of local, county or states.  They are based upon your threat level for disease.  The hot zone is the ‘ infected zone’ while the disease free zone is known as the ‘free zone’.

Enter the components of the National Animal Identification System (NAIS).  The first component is Premises Identification.  Each premises is given a unique number that is geocoded (GIS/GPS) Longitude-Latitude as we are also discovering with the 2010 Census geocoding.

These Premises Identification (PIN) numbers are for quickly:  communicating, tracing, and surveillance.  Remember, according to the powers-that-be they consider speed is  a success!

Now that all the components are in place,coordination & communication will be needed.  That means farmers and property owners will be given Incident Command training and the ICS structure will go into effect.

February 2006 was not exactly a tranquil month.  Emails and forums were blazing with communication and revelation on the National Animal Identification System known as NAIS.  Farmers were just beginning to collect information of the NAIS program.  NAIS activism was in its infancy with only a few farming journals such as Countryside exposing the sinister NAIS plan.   Walter Jeffries was just putting up his NoNAIS.org blog when Celeste Bishop called him with the news that the largest alternative media venue, Coast to Coast with George Noory, was going to cover the hot topic of NAIS.  Walter and Celeste teamed up for 48 hours to get the blog ready for the first NoNAIS activists to go live on the international air-waves.  Much appreciation is extended to Dr. Katherine Albrecht who helped get the media ball rolling on NAIS.

Everyone in farming community was furious about the program that would require:

Premises Identification:  All property that has potential to make $1000 qualifies whether you have animals or not.  Your property would be issued a 7 digit number that would cloud the your private property title and would run with your land instead of through ownership.

Electronic Animal Identification:  Livestock would need to be electronically identified in case of a “dreadful foreign animal disease”.  What the fear-mongering Department of Agriculture did not tell people was that truckloads of diseased and undocumented animals were flooding across the borders straight for your dinner table.  The USDA and state Departments of Agriculture also did not reveal the incremental implementation of a master UN plan called the Terrestrial Animal Health Code that would regulate all life on the planet earth.  It has come to light that the electronic identification may or may not be the dreaded grain size RFID that is inserted into flesh via a very large needle.  Other RFID technology is available these days including Somark, which uses an embedded RFID ink and then tattoos its victims with an invisible ink.

The third pillar of NAIS is the 24/7 surveillance (tracking or tracing-whatever you want to call it) where commingling and reporting of ‘animal’ movement would need to be reported to the government in an IRS type electronic format.

The NoNAIS journey for most of us has been one of pounding down and deciphering documents, learning to appreciate each others diverse talents, learning a *new-to-you* redefined language, leaving the farm to work with policy makers, law suits, media coverage, and communication skills.  Through the highs and the lows of NoNAIS activism we have made new friends and lost friends.  We have had abounding hard work and sacrificed many hours, dollars, and family time.

Do farmers think that the NoNAIS battle is worth it?  Absolutely!  Freedom to preserve farm-freedom so that we may all eat pure food is precious.  Unpolluted food from local small farmers is a valuable commodity to you the consumer.  The days of famine are rapidly approaching when your local farmer will not be able to farm and you will be stuck with polluted food!  If we, farmer and consumer, sit back and let someone else fight the “food-fight” we will get exactly what we put in, something that looks like food, but is not.

Will Coast to Coast cover an update on the current famine threat created by over regulation of traditional and small agriculture?  So far this You Tube has had 500+ hits.  We the People can drive that number much higher and show that folks are concerned about uncontaminated local foods.

AVMA Updates their Electronic Animal (RFID) FAQ

In October 2009 the AVMA updated their electronic animal identification (RFID) FAQ.  The document has a heavy pro-RFID bias although does minimally cover RFID problems.  The main reason cited for getting an animal electronically identified is for reunification purposes only.  Disease surveillance and prevention was only mentioned in the context that RFID ‘chips’ can provide animal temperature data.

The National Animal Identification System, NAIS, on your mind?  The FAS Transportation Data Management System retrieves premise identification listings, datamines with extraction of local, county, state, regional, and national farm and asett information.  FASTRANS is NASS (yes, our ‘friend’ in the farm census) compliant.  ConOps will use NASS data for traceback information.  In the future, coming soon to a farm near you, ConOps will send a description of a selected premises for quarantine orders.  Henceforth and forevermore, the powers-that-be have decreed by royal command that the public (our) highways and by-ways will be referred to as ‘vectors’.

This program works with FASCAT.  These programs wrap around public law and HSPD 9-10 regarding agriculture.
